Does anyone know if a person who mailed in their ballot early would die before election day, would their ballot still be considered legal?

With so many states allowing for early voting sadly it's bound to happen.

We talked about this with my father in law. He voted ASAP and mailed it!

The Sec. of State said the vote would be counted as the process for notification of death takes a while.

I would say it should count because the person legally voted at the TIME they voted.

I'd say why not? Dead people get elected all the time, just ask former AG John Ashcroft. If dead-on-election-day candidates can win elections, then dead-on-election-day voters should have valid ballots.


I've a hunch this scheme favors Republican candidates though!

My assumption was if you were alive to vote it would count, but I figured they would have some kind guideline in place in case of death.

Think of it like early voting. In some states, you get to vote early. So let's say somebody does, then tips over!

Does the vote count?

Of course it does. Same applies here. VBM comes with early voting. I like that because it distributes the vote over time, which cuts down on the impact last minute smears can have.
