The ACLU is helping Craig because they know what an embarassment he is. Kind of like the French honouring Jerry Lewis to mock American tastes.
The ACLU's hope is that it will hurt the GOP.

The ACLU has filed a brief supporting Sen. Larry Craig's effort to withdraw his guilty plea after he was allegedly caught soliciting sex in an airport bathroom. The brief is available here, but basically, the ACLU says the alleged toe-tapping and hand signals -- if they even occurred -- should be protected as free speech. The police can't prove that Craig wanted sex right there in the public bathroom, which would be illegal, or a get-together somewhere private, which would be perfectly legal.
BTW: According to onetheissues.com, the ACLU has previously given Craig a 25 percent rating, saying he has an anti-civil-rights voting record.

In a way, the ACLU may be right. However, whether or not it's illegal, I think we can all agree that his behavior is unbecoming of a US Senator.
