From what I have read in the Oregonian about it (there was one or two articles in the past few months) - it's supposed to bring back some of the Yaw's food.....is that right? Apparently Yaw's was a very popular place, and Mark wants to recreate some of that.

Probably because they have to live to be a thousand years old to see a dime. :0)

I think it is an interesting concept with some legs, but I sure hope everyone involved is prepared to lose money for a while. This restaurant could fill a niche, since there really are few unique Portland rooted places to eat out anymore. I miss Farrell's, Waddle's, Rose's Ice Cream and the Organ Grinder every bit as much as Yaw's, so a place that is old school and local is always on my radar. I hope it takes off!

Aside from thier great music, many of which were hits, they appeared DAILY on national TV, via ABC's "Where The Action Is". Mr. Lindsay was on the cover of all the "teen" mags of the day, like "Tiger Beat", "Teenbeat", "16", "Hit Parader", etc.

So yeah, I'd say he qualifies as a superstar of that day.

Elvis was a superstar of the 60s. Elizabeth Taylor was a superstar of the 60s. The Raiders were the boyband of 1966-67, little Hooties or David Casssidys. They had the staying power of cotton candy. After 40 years, old men need to stop saying "groovy." It makes them look pathetic.

Amen folks! Mark was in a HUGE BAND.

Name the other 60s rooted bands who also scored with top hits in the 70s and you will start to get the scope of it. Narrow it down to acts that had a solo effort also chart in either decade and the list gets a helluva lot shorter. Here's a handful: The Beatles, The Beach Boys, The Four Seasons, The Who, Smokey Robinson & the Miracles and Jefferson Airship. Yeah, that kind of big.

Just because folks have ties to our fair city, that fact does not make them less important or less popular. This reminds me of another recent thread where some pretended that the Northwest is second fiddle. We are just as fertile a cradle for great music -- and many other arts -- as any other region in the World. Like so many wonderful things about our home, the natural humbleness takes over and we "aw shucks" about heaps of pretty phenomenal local stuff.

PR&R a "boyband"???

LISTEN to the music. Go into the album cuts. Some credit them with being at the roots of heavy metal ("Kicks", "Just Like Me").

To equate them with David Cassidy is just ignorant. You may have been there, but you didn't really hear it.

The broadcasting booth is right there in the corner front windows, it looks pretty cool at night all lit up, and they've had huge spotlights blazing out front...I love those things and you hardly ever see them anymore. When I was a kid, I thought those always meant something BIG was going on, and sad that I was missing out on it. So I finally got to dine at the Rock & Roll Cafe. The Yaws food is great and it does seem like a step back in time. I think the shakes are the most nostalgic, and I noticed the Burgers were ordered by just about everyone I saw.

The customers are generally 55-75 years old, at least when I was there.

Tons of Mark Lindsay gold records, photos and stuff on the walls.

They have coasters with the K-Hits logo on 'em and a promo for the K-HITS Dialing For Dollars contest and a bit about signing up on the KHITS website.

It was busy!

This can't be good:

Legal spat over Portland's new Rock & Roll Cafe
Posted by The Oregonian September 24, 2007 11:37AM

Former rocker Mark Lindsay's Rock & Roll Cafe opened last month brimming with nostalgia for a famous Portland band and legendary local fare: Yaw's Top Notch hamburgers and pies.
Turns out there's a problem: The Yaw family didn't sign on.
Stephen Yaw and his daughter, Heidi Galusha, filed a federal lawsuit today accusing the new restaurant owners of capitalizing on the family name without permission.
Shawn J. Kolitch, a Portland attorney who represents the Yaws, said the family had been in negotiations with the restaurant's owners.
"The parties had attempted to enter into a contract, which fell through," Kolitch said. "And we're hoping on behalf of the Yaws that negotiations will resume."
William O. Geny, a Portland attorney who represents the restaurant owners, was out of town today and not immediately available for comment.
The Yaw family ran restaurants in Oregon and Washington starting in 1926 for more than 75 years.

So, what's the rest of the story? Is there a problem?

In talking with one of the investors, the story is they brought in Stephen Yaw and his daughter, Heidi Galusha as "consultants" and were set to pay them a monthly fee for the use of the Yaw's name, even tho the Rock & Roll Cafe actually now owns the Yaw's name and has a federal trademark filed. Bottomline, it looks like the lawsuit has no merit and the investors believe it will be dismissed in short order.

I've eaten there 3 or 4 times now (I work right behind it) and the burger was only so-so but the pulled pork sandwich was great! The customer service was poor the first couple of times but I chalk that up to being brand new. I hope it lasts, something really unique around here, and truly local.

Copyright, trademark and patent laws are pretty clear, if you let one lapse, you lose the rights to it.

Actually, our copyright laws are something of a maze due to amendments over the years, most notably our adoption of the Berne Convention in 1989, then that tragedy for researchers, the Copyright Term Extension Act of 1998 ("Sonny Bono" aka "Mickey Mouse"), which offered an additional 20-year renewal to the tons of stuff from the thirties, the public availability of such many had been waiting on. The forties won't become free within my lifetime.

A handy thumbnail summary: http://www.unc.edu/~unclng/public-d.htm

Plus of course the who-can-understand-it DCMA.

Looks like everything published "with notice" after 1963, or even without after 1977, is locked up beyond our lifetimes, folks. Sadly, only pre-1928 is certain to be PD today, as between then and 1964 requires research of renewal, which due to the byzantine transfers of ownership in media, is impossible in most cases to determine without an army of attorneys.

Recipes are a special category, however, which is a bit clearer. Generally, copyright doesn't apply: http://www.copyright.gov/fls/fl122.html

I don't think its the recipe's, but the "Yaws" trademark, that is at issue.

We ate there last night. It was a very pleasant experience and I was surprised to find not only the Yaws menu but also that of Meier & Frank! There are lots of pictures and several gold and platinum records hanging on the walls including at least 2 by Gerry Rafferty, which I don't quite understand because they were issued to Mark!

Mark was head of A & R for United Artists Records during the period Gerry Rafferty recorded and released his "City To City" album. You saw the Gold Album for 500,000 copies sold and the Platinum for over a Million, plus there is the "Baker Street" Gold single from the album which also sold over a million copies. Singles & albums are judged differently by RIAA. A platinum single would be 2 Million copies.

In case you didn't see Saturday's (11/17/07) Oregonian... Owners of Mark Lindsay's Rock & Roll Cafe said Friday that they'll drop Yaw's Top Notch food and memorabilia, ending a dispute with the family behind Portland's iconic burger joint. Owners say the Yaw's name legal challenge became a "distraction."

Steve Yaw and his daughter, Heidi Galusha, say they didn't receive the payment they were promised and didn't have enough control over the food.

Yaws will not stand on it's own. They tried in Vancouver and it failed. They should have tried harder for a deal because now it will just likely go away again and likely this time forever.

Mark Lindsay has enough of a trademark all of his own.

Does he really need Yaw's? I dont think so.

Cool idea but not worth all this trouble since he pretty much has a bigger brand than Yaws ever did.

If the food was bad or a poor use of the Yaws image then i could understand but according to reports here and elsewhere they did a pretty good representation.

Yaws should welcome such a tribute to their own name and brand... assuming fair compensation... unless of course they are planning to use it again themselves.

I dunno about "Yaws" anymore . . . especially after reading a letter-to-the-editor from an African-American Portlander who told of not being allowed to eat at Yaws when he was growing up because of his race.

Maybe it is time to leave Yaws in the past. Mark Lindsay sound like a decent image to build a brand around.

I used to frequent Yaws back around 1962. For the life of me, I couldn't tell you now what that hamburger tasted like. I don't remember. We went there because of the "social" scene. The food was secondary.

We also used to hang out at the Speck on Foster and Powell. I do remember that hamburger because it had a distinct different flavor. This was also a "social" place. But the burgers were distinctly different. There is nothing today that resembles what was then with Yaws, Speck, Flanagans, Bonnies,Skyline...etc. There was even a place in Salem and Kelso that we would just drive to for a hamburger back then. Don't remember the names of them. All that nostalgia is gone with the proliferation of fast food joints on every corner, now.

I think the Rock and Roll Cafe was the best bet the Yaws had for keeping their name going. Even if they started up again by themselves, it wouldn't be the same. For them to make it a success, they would have to tear down the McDonalds and rebuild Yaws as it was. Even so, what makes it now is the memories of the generation that seems to be ignored these days. Except for initial curiousity, I doubt todays current potential new customers would flock to it. People now are into the McDonalds/Burger King/Carls/JackinBox/Etc.............

Hmmmmmm. Sounds like the daughter is a money grubber. They are the ones tarnishing the Yaw name and image, NOT Mark and the Rock & Roll Cafe.
